When can you become tax-resident in Colombia?
DIAN's published presence test is more than 183 days, including entry and exit days, in any consecutive 365-day period. Where that period spans tax years, the rule identifies residence from the second year. Other residence tests can also apply; a calendar-year holiday counter is not a complete assessment.
Visa status and tax residence are different. A digital-nomad visa or foreign pension does not, by itself, make income tax-free. Before moving, ask a Colombian tax professional to assess your residence, income sources, assets and filing obligations alongside the rules of your other country.
Do not rely on a US–Colombia income-tax treaty
Colombia is not listed on the IRS's current A-to-Z list of US income-tax treaties, checked on September 16, 2026. Do not assume a treaty removes double taxation or exempts your pension. Other mechanisms or credits may be relevant, but they require an individual assessment.
The previous version of this site incorrectly described a treaty and a blanket five-year foreign-income exemption. Those statements have been removed. Do not use them for a filing or relocation decision.
Put the decision in context

Prepare a useful consultation file
- A dated travel log with every arrival and departure, including short trips.
- Your citizenships, current tax-residence position and proposed move dates.
- Income by type and country: salary, business income, pension, rent, dividends and gains.
- Property, bank and investment accounts, business ownership and dependants.
- Prior returns and taxes already paid, shared through the adviser's secure process.
Ask which income and asset disclosures apply, whether registration is required, how amounts are converted to pesos, and what records support any credit or relief. Obtain a dated written explanation of the assumptions behind the advice.
Budget for compliance, not only a tax bill
Allow for accounting fees, translations and records retrieval. A quoted tax percentage without a defined income type, tax year and residence position is not a usable estimate. Filing obligations and tax payable are also different questions.
Put deadlines in your calendar using the current DIAN schedule and your actual taxpayer details. Revisit the plan if your stay lengthens, you start local work, buy property or change the way a business pays you.
